NIERY BENITO CASTILLO ALEJANDRO, JR., also known as NIERY CASTILLO ALEJANDRO, Filipino, of legal age, single, a resident of Brgy. Ginictan, Altavas, Aklan, in a verified petition prays that the entry appearing in her Certificate of Live Birth particularly the entry as to her sex be changed from "Male" to "Female", her first name from NIERY BENITO to NIERY and her family name from ALEJANDRO, JR. to ALEJANDRO, in order to avoid confusion and to put in order the entries in her Certificate of Live Birth.
It appearing that the petition is sufficient in form and substance, the Court hereby sets its hearing on June 13, 2007 at 10:30 in the morning, at which time, all interested parties may appear and show cause why this petition should not be granted.
Let copy of this Order be published once a week for three consecutive weeks in Madyaas Pen, a newspaper of general circulation published in the Province of Aklan, and notice of this Order, together with the petition, be furnished the Honorable Solicitor General, the Provincial Prosecutor of Aklan, the Municipal Civil Registrar of Altavas, Aklan, the Civil Registrar General, the petitioner and her counsel, Atty. I, NENITA DE PEDRO, of legal age, Filipino married to ARSENIO DE MARTIN, now deceased, with residence at Tibiao, Altavas, Aklan, Philippines, and we RIALINA M. BAYLON, LORINA M. CATUIRAN, ERNA M. DE MARTIN, FLORINA DE MARTIN, MERCEDITA DE MARTIN and EDGELITO DE MARTIN, all of legal age, Filipino, single, with residence at Altavas, Aklan, Philippines, who are the only children of ARSENIO DE MARTIN and NENITA DE PEDRO, for and in consideration of TWO HUNDRED THOUSAND PESOS (P200,000) Philippine currency, to us in hand paid by and receipt of which is hereby acknowledged from ERNA M. DE MARTIN of legal age, FILIPINO, single, with residence at Altavas, Aklan, DO hereby SELL, cede TRANSFER AND CONVEY, in a manner absolute and irrevocable, to said ERNA M. DE MARTIN, her heirs, successors, executors, administrators or assign, one parcel of land covered by original Certificate of Title No. P-30779 with free patent No. (VI-3) 120051, including all improvements existing thereon.
That we hereby warrant that we have clear, absolute, and exclusive legal title over the parcel of land of herein sold and conveyed, that said property is free from charges, liens and encumbrances; that we served 30-day notice to all adjoining owners and possible redemption and pre-emptioners regarding this sale but none of them is interested in buying said land, that we shall defend the title of the vendee against the claim of any person whoever, that said parcel of land is not registered under Spanish mortgage law. And we hereby agree to register this document in the office of the Register of Deeds Aklan in accordance with law.
This contract is free of the circumstances that invalidate a contract under the provisions of PD 27.
