Boracay Police Files Multiple Charges Against Restaurant Owner


Tourist police of Boracay Special Tourist Police Office (BSTPO) files multiple charges against suspect identified as Mark Ryan Montibon y Trifalgar, 33 years old, married, owner of Marmar Restaurant located at Brgy Balabag, Malay, Aklan.


Boracay chief of police Superintendent Samuel Nacion reported the incident transpired at Summer Place Resto, Brgy Balabag, Malay Aklan on Thursday morning, Sept. 29. The suspect now faces charges of Violation of Presidential Decree 1866 as amended by RA 8294 or Illegal Possession of Firearm, Batas Pambansa Bilang 6 or Illegal Possession of Deadly Weapon, Other Light Threats, and Resistance and Disobedience upon Agent of person in authority.


Investigation disclosed Montibon, observed to be under the influence of liquor, arrived at Summer Place. He joined the group of people having a party. At around 5:07 AM of September 29, the said suspect was hit on the neck by unidentified person wherein he was pacified by the complainant Alwinito Flores y Lawas, 36 years old, single and presently staying at Sitio Bantud, Brgy Manoc-Manoc, Malay, Aklan. A heated argument ensued between them. The suspect went out of the bar and drew his firearm from his color black clutch bag and pointed it to the complainant.


Upon arrival of police at said bar, suspect suddenly fled riding on his bicycle but he fell down and ran along the beach. PO2 Melvin Dindap chased him and shouted to stop but the latter drew his firearm and pointed to PO2 Gindap. Later, Montibon dropped his firearm and surrendered.


Recovered from the suspect’s possession and control are one (1) Caspian .380 caliber with one (1) magazine loaded of seven (7) live ammos, color black clutch bag, one (1) color black small flash light and three (3) pieces of Shurican (sharp-pointed star shape metal).


Montibon is presently under the custody of BSTPO together with the recovered evidence for proper disposition and filing of inquest case. /MP
