Court Denies Kalibo Ambulant Vendor’s Call For TRO
Regional Trial Court (RTC), Branch 6 denies the preliminary mandatory injunction petitioned by the Kalibo Ambulant Vendors Association against the Municipality of Kalibo. The decision was released on June 16, 2006. Judge Niovady M. Marin of RTC, Branch 6 Kalibo, Aklan dismissed the petition for lack of merit. It was found out that the petitioners have not paid the necessary business and Mayor’s permit fees for the current year. Some of the business and Mayor’s permits presented were already expired.
On the basis of Ordinance No. 2002 – 057 as implemented, this allowed the ambulant vendors to occupy portion of the sidewalks and road shoulders during market days. However, the ambulant vendors occupied the whole busy portion of Toting Reyes Street. The practice resulted to heavy traffic experienced, commerce and trade were disrupted, public health and safety were threatened as dumping and littering of garbage were unchecked and the essential lifeline in the Municipality of Kalibo was cut off.
Kalibo Mayor Raymar A. Rebaldo permitted the ambulant vendors to sell their wares and products at the new Satellite Market at Oyo Torong Street near the Provincial Transport terminal. However, the ambulant vendors insisted to occupy Toting Reyes Street to sell their goods and this is not possible./MP
