A verified petition dated September 25, 2008 was filed by the petitioner, through counsel, praying that after due notice, publication and hearing, The Municipal Civil Registrar of Altavas, Aklan and National Statistics Office (NSO) be ordered to correct certain entries in the birth certificate of petitioner Josuah Wilrey C. Fuentes under LCR No. 565 (J-82).

It appearing that the petition is sufficient in form and substance, the Court hereby sets the initial hearing of the aforesaid petition on December 10, 2008 at 8:30 in the morning, and directs that a copy of this Order be published immediately at the expense of the petitioner in the “Madyaas Pen”, a newspaper published, and with general circulation in the Province of Aklan once a week for three (3) consecutive weeks.

All persons having or claiming any interest under the entry whose correction is sought may, within fifteen (15) days from notice of petition, or from last date of publication of such notice, file their opposition thereto.

Let copies of this Order together with copies of the petition be served upon the Solicitor General, the Provincial Prosecutor of Aklan, the respondents The Municipal Civil Registrar of Altavas, Aklan, National Statistics Office (NSO), Manila, the petitioner and his counsel.

The quintessence of the above-captioned petition is that the petitioner was actually born on August 26, 1954 in Alegria, Buruanga, Aklan. But when he tried to get a copy of his birth certificate from the municipality he was issued a certification on November 5, 1993 that he has no record of birth thereat, prompting him to make a late registration of his birth. He was accordingly issued a Certificate of Live Birth on February 27, 1996.

However, when he secured a copy of his Certificate of Live Birth from the National Statistics Office (NSO) he was issued/different one emanating from Civil Registry of Nabas, Capiz (now Aklan). It contained erroneous entry of his date of birth as August 20, 1954 instead of August 26, incomplete name of his father as Paquito S. Palomata instead of Paquito Solanoy Palomata, Sr. and her mother as Restituta Cahilo instead of Restituta Cahilig Cahilo. He prayed for an order of cancellation of Nabas Certificate of Live Birth and instead his certificate of live birth from the Municipal Civil Registrar of Buruanga be maintained and recorded with the National Statistics Office (NSO).

Finding the petition to be sufficient in form and substance, notice is hereby given that the aforesaid petition will be heard by this court on DECEMBER 11, 2008 at 10:30 A.M. at the Session Hall of Branch 7 of this court. The Civil Registrar and any person having or claiming interest or whose interest will be affected by the cancellation and substitution sought may file his opposition thereto within fifteen (15) days from notice of the petition, or from the last date of publication of such notice.

Let this Order be published at the expense of the petitioner once a week for three (3) consecutive weeks in Madyaas Pen, a newspaper of general circulation in the province of Aklan and copies of the same together with the petition be served upon the Solicitor General, 134 Amorsolo Street, Legaspi Village, Makati, the Provincial Prosecutor of Aklan, the Municipal Civil Registrars of Nabas, Aklan and Buruanga, Aklan and Civil Registrar General, National Statistics Office and copies of the order to counsel for the petitioner and the petitioner.
