Militants in Kalibo, Aklan lauded the decision of the Supreme Court dismissing the charges of rebellion filed by the Department of Justice against six leftist lawmakers.
George Calaor of Bagong Alyansang Ma-kabayan (Bayan) Aklan said the decision is a triumph of justice for the persecution of the national government against the so-called Batasan 6 – Crispin Beltran, Saturnino Ocampo, Joel Virador, Rafael Mariano, Liza Maza and Teodoro Casiño.
Associate Justice Antonio Carpio of the Second Division said "the filing of charges was in haste and there was the obvious involvement of political considerations in the rebellion charges."
The SC also ordered the Makati City Regional Trial Court to dismiss Criminal Cases No. 06452 and 06944 against the leftist lawmakers for alleged attempt to overthrow the government in 2006.
"The militant groups are vindicated by the recent decision of the Supreme Court (citing the) lack of evidence where the inquest proceedings were tainted with irregularities to indict the lawmakers," Calaor added.
The SC also warned the government prosecutors "to avoid giving the impression that their noble office is being used or prostituted, wittingly and unwittingly, for political ends, or other purposes alien to, or subversive of, the basic and fundamental objective of observing the interest of justice even-handedly, without fear or favor, to any and all litigants alike, whether rich or poor, weak or strong, powerless or mighty."
The Court also made it clear that the arresting officers of Beltran have no personal knowledge of facts and circumstances that the lawmaker committed rebellion against the government in February 2006. /MP
