Pretty House Made Ugly

Picture shows, at right, the house of the late Salvador Salazar and Mrs. Caridad Sarabia Salazar. The house is constructed in the 1950’s just in front of Mabini Street, across Dr. Rafael S. Tumbokon Memorial Hospital, Kalibo, Aklan.
After its completion, the ground floor was used as a drugstore: Farmacia Caridad. The ground floor is now being used as automotive tire store named: Earl Tire Center. This tire center is owned and managed by Mr. and Mrs. Errol Fulgencio.
According to records, the lot where the house stands is owned by a brother and sister who are Caridad M. Sarabia Salazar and Mr. Diosdado Sarabia. Diosdado used to live in the United States, but he is now in the great beyond. His heirs sold Diosdado Sarabia’s share of the land where one half (1/2) of the house stands to Mrs. Elsie Andrade Salazar.
Who Is Elsie A. Salazar?
Elsie was originally from Bay-ang, Batan, Aklan. In her young age, she was the saleslady in Farmacia Caridad situated in the ground floor of the house. In the course of her employment, the late Emiliano S. Salazar felt so madly in love with her. "Love begets love" and they were married.
By virtue of her marriage to Emiliano who was the son of Caridad S. Salazar, Elsie became the daughter-in-law of Caridad, the house owner. Elsie, after her marriage, studied Education and after her college graduation, became a teacher. In late 1980’s, she left teaching and got a job in the provincial capitol, Kalibo, Aklan
Lot
Possession
One half (1/2) of the land where the house stands owned by the late Salvador Salazar and Caridad S. Salazar is titled in the name of Mrs. Elsie Salazar. She claimed ownership by virtue of a Deed of Sale signed by the heirs of Diosdado Sarabia, which was later converted to "Deed of Donation". However, she was not in absolute possession as the house of her mother-in-law, Caridad is still occupying it. She has difficult access to it, she stressed.
Therefore, at dawn of Saturday, September 30, with the assistance of a squad of security guards from Tripple A agency under the supervision and control of the retired PNP Director of Aklan Nemesio Neron, laborers began digging as a start to construct perimeter fence around Elsie’s property.
Led by Col. Neron, retired and Ms. Elsie Salazar, there were the elements of surprise as it was done without notice to Erlinda, her mother Mrs. Caridad S. Salazar and Mr. Errol Fulgencio. Mrs. Caridad Salazar is Elsie’s mother-in-law, Erlinda is Elsie’s sister in law, being the sister of Emiliano – Elsie’s husband and Errol Fulgencio is Erlinda’s husband. Ms. Salazar is living on bonus age and staying in that house.
There was the element of force as several security guards surrounded the house with their arms under the command of a retired colonel of the PNP. There was likewise the element of time as it was done on an early morning of Saturday when government offices were closed including the courts of justice.
The spouses Errol and Erlinda Fulgencio who are living with their mother, Caridad requested Elsie and Col. Neron for the postponement of the construction so as to continue the peace their mother is enjoying in the house.
However, the construction continued. Mrs. Elsie Salazar stressed, she owns the land and she has the permit issued by LGU Kalibo to construct the fence. As to Col. Neron, "trabaho lang" (just a work to do). The construction must continue and it continued.
The following day, Sunday, Elsie and Erlinda held a negotiation in the PNP Provincial Office, Camp Pastor Martelino, Old Buswang, Kalibo with PNP Provincial Director William Macavinta as go between. Mr. Neron was also present. I was present in the dialogue as observer. I was cordially invited by Errol and Erlinda just to observe. Meanwhile, the construction went on in the site simultaneously with the dialogue.
After about one hour of exchanges of views, the two parties came to a certain agreement. The dialogue ended, the parties proceeded to the fencing site with Col. Macavinta. With our presence, Erlinda and Errol on the one hand agreed to drop all court cases and that the fence construction can proceed. Elsie on the other hand, in return consented to give a portion of her lot at the back of the house.
The following evening, Elsie and company ate dinner in her mother-in-law’s house, Mrs. Caridad Salazar who was resting in her room, and with the spouse Errol and Erlinda. They signed a covenant, according to Ms. Erlinda Fulgencio, on what each party will do. The following day, Mrs. Elsie Salazar got back their signed agreement, said Mrs. Fulgencio.
Meanwhile, Engr. Emerson S. Lachica, municipal engineer of Kalibo issued order to stop the construction for violation of some provision of the "fencing permit" issued by his office. During the visit of the MP, the carpenters were on "standby". They were not working. The security guards were still there. According to one who gave his name as Mr. Raphy Rodriguez, the structure they planned and started constructing where Col. Neron may hold office maybe demolished. /MP mailto:madyaas_pen@yahoo.com
